Stop repossession

About to lose your vehicle? We move quickly to stop the repossession so you can keep getting to work and keep your life moving.

Filing bankruptcy in southeast Michigan

Detroit and Flint area cases are heard in the Eastern District of Michigan. Here is how it works.

Detroit courthouse

U.S. Bankruptcy Court, Eastern District of Michigan, 211 West Fort Street, Detroit, MI 48226. Serves Wayne, Oakland, Macomb, Washtenaw, and nearby counties.

Flint courthouse

U.S. Bankruptcy Court, 226 West Second Street, Flint, MI 48502. Serves Genesee, Lapeer, Livingston, Shiawassee, St. Clair, and Sanilac counties.

Both courthouses are part of the Eastern District of Michigan, which covers Detroit, Flint, and the rest of southeast Michigan. If you are in west Michigan, such as Grand Rapids or Kalamazoo, your case falls under the separate Western District. Confirming the right court for your county is part of getting your case filed correctly the first time, and we handle that for you.

You also will not be standing in front of a judge in most cases. The one required hearing, the 341 meeting of creditors, is held by Zoom or phone. We prepare your paperwork, file the case, and walk you through that meeting in advance so there are no surprises.

In Michigan, you get to choose

Unlike many states, Michigan lets you pick either the Michigan state exemptions or the federal exemptions, whichever keeps more of your property. You cannot mix them, so choosing the right set matters. That is one of the first things we figure out for you.

Your homeMichigan's homestead exemption protects roughly $46,000 of home equity, and more if you are 65 or older or disabled. The federal set may be better for renters.
Your vehicleMost filers keep their car as long as payments stay current.
Your retirement401(k), IRA, and most pensions are generally protected under either set.
The better of two systemsWe run your case under both Michigan and federal exemptions and choose the one that protects the most.

Exemptions depend on your specific situation. We review your numbers with you before you file so you know exactly what is protected.

What our clients say

Michigan bankruptcy FAQs

Straight answers to what Detroit and Flint area clients ask us most.

Which court will my Michigan bankruptcy be filed in?
If you live in the Detroit or Flint area, your case is filed in the Eastern District of Michigan. The Detroit courthouse is at 211 West Fort Street and the Flint courthouse is at 226 West Second Street. West Michigan, such as Grand Rapids, falls under the separate Western District.
Do I have to appear in court in person?
In most cases, no. The one required meeting, the 341 meeting of creditors, is held by Zoom or phone. We prepare and file your case while you stay home, and we walk you through the meeting beforehand.
Can I choose between Michigan and federal exemptions?
Yes. Michigan lets you choose either the Michigan state exemptions or the federal exemptions, whichever protects more, though you cannot mix the two. Michigan's homestead exemption protects roughly $46,000 of equity, more if you are 65 or older or disabled, while the federal set is often better for renters. We run both and pick the one that keeps the most for you.
Will filing stop a wage garnishment or foreclosure?
Yes. The moment your case is filed, the automatic stay takes effect and most creditors must stop garnishment, foreclosure, repossession, and collection calls. If you are facing an active garnishment or a sheriff's sale date, that is exactly why we offer urgent same-day and weekend appointments.
Which Michigan areas do you serve?
We serve Detroit, Flint, and southeast Michigan, including Warren, Sterling Heights, Troy, Livonia, Dearborn, Southfield, and Pontiac, across Wayne, Oakland, Macomb, Genesee, Washtenaw, and Lapeer counties.
